Was ist hier völlig aus dem Ruder gelaufen? In einem Flugblatt der CDU-Bediensteten werde daher nicht nur ein „Verbot der Queer-Symbolik auf Kantinen-Speiseplänen“ gefordert. Darüber hinaus solle auch „Leipziger Allerlei“ aus dem Kantinenbetrieb verbannt werden. Das Wort „Allerlei“, so die Begründung, stehe für einen „Multikulti-Mischmasch“, der nicht zum eigenen Werteverständnis passe. Die Klärung des Kantinenkonflikts ist vorrangige politische Aufgabe in Freiburg: Wahrung beamtenrechtlicher Neutralität, Fürsorgepflicht und Gleichbehandlung in der Stadtverwaltung Freiburg. Die Klärung des aktuellen Konflikts um den Speiseplan der Betriebskantine der Stadtverwaltung Freiburg stellt aus Sicht der Ortsverwaltung Freiburg-Kappel eine der vorrangig von der Politik zu lösenden Aufgaben dar, da hierbei zentrale beamtenrechtliche Grundsätze berührt sind. In den vergangenen Wochen ist es innerhalb der Verwaltung der Stadt Freiburg zu Auseinandersetzungen über einzelne angebotene Gerichte und deren Bezeichnungen gekommen. Anlass ist eine Initiative einzelner Beschäftigter – Parteimitglieder der CDU –, die insbesondere die Aufnahme der „Regenbogenforelle mit buntem Salat“ sowie des Gerichts „Leipziger Allerlei“ als problematisch bewertet und zu einem Boykott der Kantine aufgerufen hat. In diesem Zusammenhang wurden zudem mögliche rechtliche Schritte gegen die Stadt als Betreiberin der Kantine angekündigt, verbunden mit dem Vorwurf einer vermeintlichen politischen oder weltanschaulichen Einflussnahme. Die Ortsverwaltung Freiburg-Kappel vertreten durch Ihren Ortsverwalter Christoph Brender stellt klar, dass es sich bei der Regenbogenforelle um eine fachlich anerkannte und lebensmittelrechtlich korrekte Bezeichnung einer Fischart handelt und dass auch „Leipziger Allerlei“ eine traditionelle Speisebezeichnung ohne politischen oder ideologischen Bezug ist. Die Auswahl und Benennung der Gerichte in der Betriebskantine erfolgt ausschließlich auf Grundlage objektiver Kriterien, insbesondere ernährungswissenschaftlicher Empfehlungen, wirtschaftlicher Erfordernisse sowie geltender Hygiene-, Vergabe- und Qualitätsstandards. Eine politische Intention ist damit nicht verbunden. Gleichwohl gewinnt der Vorgang eine grundsätzliche Bedeutung, da die Betriebskantine Teil der beamten- und arbeitsrechtlichen Fürsorgepflicht des Dienstherrn ist. Nach den einschlägigen beamtenrechtlichen Regelungen ist die Stadt Freiburg verpflichtet, für gleichwertige, sachgerechte und diskriminierungsfreie Arbeitsbedingungen zu sorgen. Hierzu zählt auch ein ausgewogenes und gesundheitsförderndes Verpflegungsangebot, das den anerkannten Standards der Arbeitsmedizin entspricht. Eingriffe in bestehende Kantinenabläufe aufgrund subjektiver Deutungen einzelner Begriffe würden nicht nur die Gleichbehandlung der Beschäftigten gefährden, sondern auch die Rechtssicherheit des Verwaltungshandelns insgesamt in Frage stellen. Aus beamtenrechtlicher Sicht ist zudem der Grundsatz staatlicher Neutralität zu beachten. Dieser verpflichtet den Dienstherrn jedoch nicht dazu, jede denkbare Assoziation Einzelner zu berücksichtigen, sondern verlangt vielmehr, dass Entscheidungen auf überprüfbaren, sachlichen Kriterien beruhen. Würde die Verwaltung beginnen, fachlich korrekte Bezeichnungen oder ausgewogene Speiseangebote aus Gründen symbolischer Zuschreibungen zu verändern, entstünde ein Präzedenzfall, der mit dem Leistungs- und Gleichbehandlungsprinzip des öffentlichen Dienstes nicht vereinbar wäre. Die Thematik ist daher nicht als bloße Geschmacks- oder Einzelmeinungsfrage zu bewerten, sondern als Konflikt mit grundsätzlicher Bedeutung für das Beamten- und Arbeitsrecht. Entsprechend wurden die Fragestellungen bereits in internen Beratungen mit den zuständigen Personalvertretungen und gewerkschaftlichen Gremien erörtert. Dabei wurde übereinstimmend festgestellt, dass die Wahrung der Fürsorgepflicht, der Gleichbehandlung sowie der rechtlichen Klarheit Vorrang vor symbolpolitischen Erwägungen haben muss. Die CDU sieht nach der bevorstehenden Landtagswahl dringenden Handlungsbedarf bei der Sicherung von Ordnung, Neutralität und Funktionsfähigkeit des öffentlichen Dienstes. Der eskalierte Konflikt um den Speiseplan der Betriebskantine der Stadtverwaltung Niederklaubitz verdeutlicht exemplarisch, wie symbolpolitische Deutungskämpfe in staatliche Abläufe hineinwirken und den Dienstbetrieb belasten können. Für die CDU ist klar, dass beamtenrechtliche Grundsätze wie Fürsorgepflicht, Gleichbehandlung und Loyalität nicht durch subjektive Zuschreibungen ausgehöhlt werden dürfen. Die neue Landesregierung ist gefordert, diesen Konflikt prioritär zu klären, Rechtssicherheit herzustellen, Eskalationen zu beenden und die Handlungsfähigkeit der Verwaltung nachhaltig zu sichern. Die Ortsverwaltung sieht es daher als Aufgabe der politischen Entscheidungsträger an, diesen Konflikt zeitnah und vorrangig zu klären, um Rechtssicherheit für alle Beteiligten zu gewährleisten. Ziel bleibt es, einen ordnungsgemäßen, rechtmäßigen und sachlich begründeten Betrieb der städtischen Kantine sicherzustellen und zugleich die beamtenrechtlichen Grundprinzipien von Neutralität, Fürsorge und Gleichbehandlung konsequent zu wahren.
