I have a theory (possibly just a hunch) that Australian courts are more willing to declare anti-protest laws unconstitutional because they look at them through the prism of freedom of expression rather than freedom of assembly, which at least under the ECHR is often interpreted narrowly.

Why don't they have to prove that the law they propose to institute is "legal" in the first instance, rather than it be implemented and the subject to costly and timely challenge while people are arrested, prosecuted and harassed?

It is interesting than an implied freedom of political communication, held by a Federal Court to exist without support from the express words used in the Cwth constitution, strikes down a State statute passed with the stated intent of increasing public safety. I agree with the decision BTW - but WOW

In particular, the Court has said that promoting “social cohesion”, in the sense of avoiding divisive or upsetting discourse, is not a legitimate objective that is compatible with the Australian democratic system. A strong statement.
